Mes, žemiau pasirašiusieji Lietuvos pilietinės visuomenės atstovai, esame giliai susirūpinę Vyriausybės pasirinktomis nereguliarios migracijos valdymo priemonėmis bei visuomenėje ir žiniasklaidoje formuojamu požiūriu, kuris demonizuoja nereguliarius migrantus ir pateisina žmogaus teisių pažeidimus. Išaugusi migracija į Lietuvą neabejotinai kelia iššūkių ir reikalauja plėtoti priėmimo ir integracijos strategiją ir infrastruktūrą, bet migracija nėra nusikaltimas ir prieglobsčio ieškantys žmonės nėra grėsmė. Tai – galimybė kurti įvairesnę, atviresnę, tolerantiškesnę ir turtingesnę Lietuvą.

Lietuvos Vyriausybės veiksmai pažeidžia žmogaus teises. Neneigiame, kad Baltarusijos režimas naudojasi į Europos Sąjungą siekiančiais patekti migrantais, kad darytų Lietuvai politinį spaudimą. Tačiau Baltarusijos valstybės institucijų pastangos nukreipti nereguliarios migracijos srautą nebūtų sėkmingos, jei migrantų kilmės šalys (Irakas, Kongas, Kamerūnas, Sirija, Iranas ir kt.) būtų politiškai bei ekonomiškai stabilios ir saugios oriai gyventi. Eurostat 2020 m. duomenimis, 43% Irako, 85% Sirijos ir 59% Afganistano piliečių Europos Sąjungoje pateiktų prieglobsčio prašymų  buvo patenkinta be apeliacijos. Afganistane valdžią perėmus Talibanui šios šalies piliečiai apskritai neturėtų būti grąžinami. Lietuvos Vyriausybė kaltina Baltarusijos režimą terorizmu ir sukūrė humanitarinį koridorių nuo persekiojimo bėgantiems baltarusiams, bet laiko šią šalį saugia prieglobsčio prašytojams ir kitiems migrantams. Rugpjūčio pradžioje pradėtas vykdyti priverstinis migrantų apgręžimas į Baltarusiją pažeidžia tarptautinės prieglobsčio teisės esminį negrąžinimo (non-refoulement) principą, įtvirtintą 1951 m. Ženevos konvencijoje dėl pabėgėlių statuso (33 str.) ir ES Pagrindinių teisių chartijoje (19 str.).

Neįmanoma neišnagrinėjus individualių prieglobsčio prašymų žinoti, kas turi teisę į pabėgėlio statusą, o kas ne. Todėl Konvencija dėl pabėgėlių statuso reikalauja nebausti prieglobsčio prašytojų už neteisėtą sienos kirtimą, kol nėra nustatytas jų statusas (31 str.). Išaugę nereguliarių migrantų skaičiai negali būti priežastis keisti įstatymus pamatinei žmogaus teisei į prieglobstį apriboti. ES Teisingumo Teismas pernai nusprendė, kad 2015 ir 2017 m. įstatymų pakeitimais galimybes pateikti prieglobsčio prašymą drastiškai suvaržiusi Vengrija pažeidė ES teisę. Lietuvoje šių metų liepos 13 d. ir rugpjūčio 10 d. priimtos Užsieniečių teisinės padėties įstatymo pataisos taip pat šiurkščiai de facto apriboja prieglobsčio prašytojų galimybes gauti prieglobstį šalyje bei šių asmenų teises taikant masinį sulaikymą. Lietuvos nenoras prisiimti tarptautinius įsipareigojimus kelių tūkstančių migrantų atžvilgiu stebina žinant, kiek jos gyventojų istoriškai emigravo ieškodami prieglobsčio. Vien po Antrojo pasaulinio karo iš Lietuvos nuo sovietinio režimo pasitraukė 60 tūkst. gyventojų, kurie rado prieglobstį Vakarų Europoje, Amerikoje ar Australijoje.

Migracija yra galimybė ir individui, ir visuomenei. Priimti pabėgėlius yra ne tik moralinė ir teisinė pareiga, bet ir ekonominė nauda. Nors tam reikalingos pradinės investicijos iš valstybės lėšų, jos beveik dvigubai atsiperka per penkerius metus (1) – pabėgėliams įsidarbinus ar sukūrus verslus bei prisidedant prie įvairesnės ir pakantesnės visuomenės, praturtintos naujais įgūdžiais ir inovatyviomis idėjomis. Nepagrįsta ir su migrantais siejama nusikalstamumo baimė. Duomenys iš Vokietijos, priėmusios daugiau nei milijoną prieglobsčio prašytojų 2015-2016 m., rodo, jog pabėgėliai nusikalsta ne dažniau nei vokiečiai, nors patys dažnai tampa neapykantos nusikaltimų aukomis (2).

Siekdami tvaraus sprendimo, reikalaujame iš Lietuvos Vyriausybės ir valstybės institucijų:

1. Laikytis Ženevos konvencijos dėl pabėgėlių statusoVisuotinės žmogaus teisių deklaracijos, ES Pagrindinių teisių chartijos ir užtikrinti skaidrumą;

2. Užtikrinti vaikų ir kitų pažeidžiamų migrantų grupių saugumą ir poreikių patenkinimą;

3. Nevaizduoti nereguliarių migrantų kaip agresorių, o Baltarusijos – kaip saugios jiems šalies;

4. Neapgręžti prieglobsčio prašytojų į Baltarusiją ir įpareigoti sienos apsaugos pareigūnus informuoti prieglobsčio siekiančius asmenis, kur ir kaip pateikti prieglobsčio prašymą ir sudaryti galimybes jį pateikti;

5. Priimti sprendimus dėl prieglobsčio prašytojų sulaikymo individualiai, įvertinant šios priemonės būtinybę, netaikyti masinio sulaikymo;

6. Kompetentingai išnagrinėti prieglobsčio prašymus, atsižvelgiant į individualias žmogaus aplinkybes, proceso metu užtikrinti teisinę pagalbą, informaciją ir vertimą prieglobsčio prašytojams;

7. Gerinti sąlygas apgyvendinimo centruose, suteikiant reikalingą medicininę pagalbą, informaciją ir socialines paslaugas bei užtikrinant religinius ir kitus bazinius humanitarinius poreikius;

8. Teisiškai užtikrinti galimybes nepriklausomoms organizacijoms teikti pagalbą prieglobsčio prašytojams ir vykdyti stebėseną dėl galimų jų teisių pažeidimų (3).

Applying for asylum is not a crime – for humane treatment of migrants

We, the undersigned members of Lithuanian civil society, are deeply concerned about the irregular migration management measures adopted by the Government of the Republic of Lithuania] and the attitude being shaped in our society and the media that demonises irregular migrants and justifies human rights violations. Increased migration to Lithuania undoubtedly  raises challenges and demands for developing a strategy and building an infrastructure for reception and integration, yet migration is not a crime and people seeking asylum are not a threat. It is an opportunity to create a more diverse, open, tolerant and richer Lithuania.

The actions taken by the Lithuanian government are in violation of human rights. We do not deny that the Belarusian regime is using migrants trying to reach the European Union in order to apply political pressure on Lithuania. However, the efforts of Belarusian authorities to divert the flow of irregular migration would not be successful if the countries of origin of the migrants (Iraq, Congo, Cameroon, Syria, Iran etc.) were politically and economically stable and safe enough to live a dignified life. Eurostat 2020 data shows that 43%, 85% and 59% of asylum applications submitted in the European Union by Iraqi, Syrian and Afghan citizens respectively are approved at first instance. After the Taliban takeover in Afghanistan, no Afghan citizens should be deported. The Government of Lithuania accuses the Belarusian regime of terrorism and has created a humanitarian corridor for Belarusians fleeing persecution, yet considers this country safe for migrants. The push-backs of migrants to Belarus practiced since early August are in breach of the non-refoulement principle of the international asylum law established by the 1951 Geneva Convention Relating to the Status of Refugees (Art. 33) and the EU Charter of Fundamental Rights (Art. 19).

It is impossible to know who has the right to asylum and who does not  without considering individual asylum cases. Therefore, the Geneva Convention Relating to the Status of Refugees requires that asylum seekers are not punished for crossing the border illegally until their status has been established (Art. 31). Increased numbers of migrants cannot justify amendments to the laws with the aim to restrict the fundamental human right to asylum. Last year, the Court of Justice of the EU ruled that Hungary had breached the EU law by drastically restricting access to asylum procedures with law changes in 2015 and 2017. Amendments to the Republic of Lithuania Law on the Legal Status of Aliens adopted on July 13th and August 10th also de facto heavily restrict asylum seekers’ access to asylum in our country and curtail their rights by mass detention. Lithuania’s unwillingness to assume its international obligations vis-a-vis several thousands of migrants is surprising, given how many of its residents have historically emigrated in search of asylum. At the end of the Second World War alone, 60,000 residents fled the Soviet regime in Lithuania, finding asylum in Western Europe, Americas and Australia.

Migration is an opportunity for both the individual and the society. To accept refugees is not only a legal and moral obligation – it is also an economic gain. Although it requires initial investment of public funds, the returns are almost double in five years (1) as refugees find employment or establish businesses and contribute to a more diverse and tolerant society enriched with new skills and innovative ideas. The fear of criminality associated with migrants is also unfounded. Data from Germany that had accepted more than one million asylum seekers in 2015-2016 shows that refugees do not commit crime more often than Germans, although they  themselves frequently suffer from hate crimes (2).

Seeking a sustainable solution, we demand that the Government of Lithuania and its state institutions:

1. To comply with the obligations laid down in the Geneva Convention Relating to the Status of Refugees, the Universal Declaration of Human Rights and the EU Charter of Fundamental Rights, and  to ensure transparency;

2. To ensure security and the needs of children and other vulnerable migrant groups;

3. Not to depict irregular migrants as aggressors and Belarus as a country safe for them;

4. Not to push back asylum seekers to Belarus and to obligate border guards to inform asylum seekers where and how to apply for asylum and to provide opportunities to submit the application;

5. To take decisions on the detention of asylum seekers on an individual basis, upon assessment of necessity of this measure, and not to use mass detention;

6. To competently review asylum cases with regard to individual circumstances while providing legal aid, information and translation to asylum seekers in the process;

7. To improve living conditions in the migrants’ accommodation facilities, ensuring access to necessary medical aid, basic material conditions, information, social services and to ensure religious and other basic humanitarian needs;

8. To legally ensure access for independent organisations in order to provide assistance to asylum seekers and conduct monitoring of potential violations of their rights [3].

Hibridinį karą ekonominėmis sankcijomis pradėjo Lietuva po priverstinio lėktuvo nutupdymo. O pabėgėliai ir eiliniai baltarusiai tapo atpirkimo ožiais. Migrantų apgrėžimas – tai nusikaltimas !!!

    Ne su visais teiginiais sutinku. Pvz., visus leisti per sieną. Reikia ne visus, o pažeidžiamus asmenis pagal konvenciją, t.y. moterys ir vaikai turi būti praleidžiami (greičiausiai su šeimomis, jei tokios yra). Dar galima išskirti pabėgelius, kurie prašosi prieglobsčio ir kurie ne. Pirmieji turi gauti galimybę nebūti laikomi kaip dabar – turi turėti teisę „prasivaikščioti“, kad ir porai valandų per dieną ar kažką panašaus. Bet tie, kurie nesiprašo prieglobsčio, tie gali būti traktuojami kaip nusikalteliai (pagal BK 291 straipsnio 1 dalį, nes 2 dalis jiems netaikoma). Šiuo metu tik 1/3 pasiprašė prieglobsčio
